1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Appxidian Labs (“we,” “us,” or “our”), concerning your access to and use of the appxidian.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” and “Apps”). This includes, but is not limited to, our proprietary applications.
By accessing our Site or Apps, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and Apps and you must discontinue use immediately.
2. Intellectual Property Rights
Unless otherwise indicated, the Site and Apps are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site and Apps (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
Except as expressly provided in these Terms, no part of the Site or Apps and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
3. User Data and Local Storage
Appxidian Labs engineers tools designed for deep focus and utility. Consequently, many of our applications rely on local device storage to function (such as saving game states, timers, or notes).
- Data Ownership: You retain complete ownership of the data you create using our applications.
- Data Loss: Because data is stored locally on your hardware and not on our servers, we are not responsible for any loss of data resulting from app deletion, device failure, or operating system updates. We highly recommend regularly backing up your device.
4. Prohibited Activities
You may not access or use the Site or Apps for any purpose other than that for which we make the Site and Apps available. The Site and Apps may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
As a user of the Site and Apps, you agree not to:
- Systematically retrieve data or other content from the Site or Apps to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Circumvent, disable, or otherwise interfere with security-related features of the Site or Apps.
- Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site or Apps.
5. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site or Apps at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or Apps.
We cannot guarantee the Site and Apps will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance, resulting in interruptions, delays, or errors.
6. Governing Law
These Terms shall be governed by and defined following the laws of India. Appxidian Labs and yourself irrevocably consent that the courts of West Bengal shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
